Understanding New York’s No-Fault Insurance Laws

New York is one of 12 states with no-fault laws for motor vehicle accidents. While these laws help ensure that accident victims receive something, individuals who suffered devastating injuries may not receive adequate compensation through their personal injury protection (PIP) policy.

What Benefits Are Available?

New York’s no-fault laws were enacted in the 1970s. They are intended to ensure that individuals receive compensation for lost wages, health care bills and any incidental costs associated with a motor vehicle collision. Importantly, individuals receive these benefits no matter who was at fault for the accident.

Medical expenses, occupational therapy and either 80 percent or $2,000 in lost wages, whichever is less, will be paid out because of the accident. The maximum amount of benefits you can receive is $50,000, although you may be able to receive more if you have purchased additional PIP coverage.

Filing A Personal Injury Lawsuit

While PIP provides compensation for many accident-related damages, it does not cover everything. Noneconomic losses, including emotional distress and pain and suffering, are not covered. To recover compensation, you will need to file a personal injury lawsuit.
